Terms and Conditions

Agreement

These Terms and Conditions ("Terms") govern your access to and use of https://northwind-coffee.example and the products and services we offer through it (together, the "Service"). The Service is operated by Northwind Coffee Roasters Ltd ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business or other organisation, you confirm that you are authorised to accept these Terms on its behalf, and "you" includes that organisation. If you do not agree to these Terms, do not use the Service.

These Terms take effect on 1 October 2026.

Eligibility

You must be at least 16 years old to use the Service. By using it, you confirm that you meet this requirement and that you have the legal capacity to enter into a binding agreement with us.

If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or guardian who agrees to these Terms.

Accounts

Your account

Some features of the Service require an account. When you create one, you agree to:

  • Provide accurate, current and complete information, and keep it up to date
  • Keep your password and other sign-in details confidential, and not share your account with anyone else
  • Tell us promptly at privacy@northwind-coffee.example if you suspect unauthorised access to your account

You are responsible for activity that takes place under your account, unless it results from our failure to keep the Service secure.

We may suspend or close an account where we reasonably believe it has been compromised, is being used in breach of these Terms, or must be closed to comply with the law. Where it is lawful and practical to do so, we will tell you first and explain why. You may close your account at any time.

Acceptable Use

Acceptable use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Break any applicable law or regulation, or help anyone else to do so
  • Infringe the intellectual property, privacy or other rights of any person
  • Upload or transmit viruses, malware or any other harmful code
  • Attempt to gain unauthorised access to the Service, other accounts, or the systems and networks the Service runs on
  • Interfere with, disrupt or place an unreasonable load on the Service
  • Scrape, crawl, harvest or otherwise collect data from the Service by automated means without our written permission
  • Copy, modify, reverse engineer or create derivative works of the Service, except to the extent the law expressly permits
  • Use the Service to send unsolicited commercial messages, or to impersonate any person or misrepresent your affiliation with anyone
  • Use the Service in any way that could harm us, our users or the public

Content

Content you post

Paid clause. This section is written for you when your answers need it — “User-generated content”, $14, paid once per policy.

Our intellectual property

The Service and everything in it that is not Your Content — including its software, design, text, graphics, logos and trade marks — is owned by Northwind Coffee Roasters Ltd or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose. These Terms do not transfer any ownership rights to you, and all rights not expressly granted are reserved.

Payments

Fees and payment

Paid clause. This section is written for you when your answers need it — “Payments”, $14, paid once per policy.

Subscriptions and renewal

Paid clause. This section is written for you when your answers need it — “Subscriptions”, $14, paid once per policy.

Refunds

Refunds and returns are governed by our Refund Policy, which forms part of these Terms. Nothing in the Refund Policy limits any rights you have under consumer protection law.

Liability and Termination

Service availability

We work to keep the Service available and running well, but we do not guarantee that it will be uninterrupted, timely or error-free. We may suspend the Service, in whole or in part, for maintenance, security reasons or events beyond our reasonable control, and we will try to give advance notice of planned maintenance where practical.

We may change, update or withdraw features of the Service from time to time. If a change materially reduces a paid service you have already bought, we will tell you and, where you are entitled to it, offer you a remedy such as a pro-rata refund.

Disclaimer

Except as expressly set out in these Terms, and to the fullest extent permitted by law, the Service is provided "as is" and "as available", and we make no warranties or representations of any kind, whether express, implied or statutory — including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement.

Information on the Service is provided for general purposes only. It is not professional advice, and you should not rely on it as such.

Nothing in this section affects any warranty or right that cannot be excluded under the law that applies to you.

Limitation of liability
What we are not liable for

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profits, revenue, business, goodwill or data, arising out of or in connection with the Service or these Terms, however caused, even if we were advised of the possibility of it.

Our maximum liability

To the fullest extent permitted by law, our total liability to you for all claims arising out of or in connection with the Service or these Terms is limited to the greater of (a) the total amount you paid us for the Service in the twelve months before the event giving rise to the claim, and (b) one hundred units of the currency in which you paid us, or one hundred US dollars if you have not paid us.

What we do not exclude

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law. If you are a consumer, nothing in these Terms affects your statutory rights.

Indemnity for business users

If you use the Service for the purposes of your trade, business, craft or profession, you agree to indemnify us against any claims, losses, damages and reasonable costs (including reasonable legal fees) that arise from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

This section does not apply to consumers.

Your statutory rights

Paid clause. This section is written for you when your answers need it — “GDPR wording (European Union)”, $34, paid once per policy.

Termination

You may stop using the Service at any time.

We may suspend or end your access to the Service, with notice where reasonably possible, if you materially or repeatedly breach these Terms, if we are required to by law, or if we stop providing the Service. Where we end access to a paid service for reasons other than your breach, we will refund any amount you have paid in advance for the period after termination.

When these Terms end, the rights granted to you end with them. Sections that by their nature should continue — including intellectual property, the disclaimer, limitation of liability, indemnity, and governing law — survive termination.

General

Privacy

Our Privacy Policy explains how we collect and use personal data when you use the Service. Please read it carefully. Where the Privacy Policy describes how we handle your data, it applies alongside these Terms.

Changes to these terms

We may update these Terms from time to time — for example, to reflect changes to the Service, our business or the law. We will publish the updated Terms with a new effective date.

If a change is material, we will give you reasonable advance notice — by email or through the Service — before it takes effect. If you do not agree to the updated Terms, you may stop using the Service and, if you have a subscription, cancel it before the change takes effect. If you continue to use the Service after the change takes effect, the updated Terms apply to you.

Governing law

These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any such dispute or claim.

If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country.

Before starting proceedings, please contact us at privacy@northwind-coffee.example so that we can try to resolve the matter informally.

Other important terms
  • Entire agreement — these Terms, together with the policies they refer to, are the whole agreement between you and us about the Service
  • Severability — if a court finds any part of these Terms invalid or unenforceable, the rest remains in effect
  • No waiver — if we delay or do not enforce any part of these Terms, we can still enforce it later
  • Assignment — you may not transfer your rights under these Terms without our consent. We may transfer ours to another organisation, provided this does not reduce your rights
  • Events outside our control — we are not responsible for delays or failures caused by events beyond our reasonable control
  • Third parties — no one other than you and us has any right to enforce these Terms

FAQ

About this template

Can I copy this terms and conditions template?

This sample is written for a fictional business, Northwind Coffee Roasters Ltd, and its answers are not yours. The generator builds the same document from your own answers — your name, your website, the tools you actually use — and it is free to create and download.

Why are some sections shown as paid?

They are specialist wording that is only added when your answers need it, priced once per policy. The sample keeps their headings so you can see where they go.

Is this template legal advice?

No. Policy Monster is not a law firm and does not give legal advice. For advice about your own situation, speak to a qualified lawyer.
